Unless otherwise agreed to in writing, the following terms and conditions presented on this site, will be apply to all commercial transactions for goods or services at https://shop.vescape.com, domain that holds Vescape GmbH, legally registered company, which headquarter is in Germany (VAT number: DE276345071)
Vescape GmbH reserves the right to change commercial offers on the website (modifications of products, prices, promotions and other commercial or service terms and conditions) at any time, as long as those modifications do not apply to previously hired services.
Vescape GmbH is not directly or indirectly responsible for any of the product information or content shown on https://shop.vescape.com. The manufacturer or supplier of the product is responsible for this at any time. The client understands that Vescape GmbH is a mere intermediary.
1. Legal Information about Vescape GmbH
Vescape GmbH, Zionskirchstr. 51, 10119 Berlin, Germany, VAT number: DE276345071, registered at the commercial register of Berlin Charlottenburg under the number HRB 132878, is the owner of the Online Fitness Shop https://shop.vescape.com.
2. Online Purchase
To purchase, please add the articles you want to buy to the "shopping basket" and follow the instructions. To finish this process, which includes registration of your personal information so that we are able to identify who you are, the order will be transmitted to Vescape GmbH in order to be processed. You will receive a confirmation of your order per e-mail.
3. Applicable Taxes
According to the European law (Council Directive 2006/112/EC of 28 November 2006 on the common system of value added tax), physical products are subject to Value Added Tax (VAT). The VAT is included in the prices displayed on the Vescape Online Shop. This condition does not include any natural or legal person from outside the European Union VAT.
4. Payment methods
Vescape GmbH offers different payment methods: credit card (MasterCard, Visa), bank transfer, PayPal, Sofort Überweisung. All payments are secured and encrypted.
5. Delivery Service and Costs
The delivery date may vary according to the availability of the products and the destination of delivery. The products are usually delivered within 2 and 10 business days.
6. Customers rights and return policy
The customer has 14 days to return a product, under the conditions specified below. The client must contact Vescape GmbH per post or per e-mail with the reference of the product. The returned order will be collected by a transport company. The product or item must be in its original packaging with the original delivery note or invoice.
In the event of any product or item being received in bad conditions, either develops a fault or is found to be faulty upon delivery, for the reparation or replacement of the product, please take in account the following: both reparation and replacement; that means that you may return it (in its original packaging, freight prepaid) to Vescape GmbH, and in case of reparation, labour and spare parts are covered by the guarantee.
Please note that most products on our web site are covered by a two-year guarantee.
To qualify for this guarantee the customer must advise Vescape GmbH within 14 days months after finding out the product is faulty.
1) Collection of faulty products
In the case of an item being found faulty upon delivery, we will arrange to have it collected free of charge. The item must be returned in its original packaging, and then be packed in secure appropriate packaging. Please note that the item must be available for collection within 24 hours of you letting us know it is faulty.
Once the item is received back, it will be inspected and if necessary a new product will be delivered to you. Your invoice is your proof of purchase and has to be sent back to us together with the item. If any item received when purchasing is found to be missing on inspection, you will have to pay for it in full.
If the product is NOT found faulty on inspection, we may send it back to you and delivery costs will be payable by you.
Please note that you could be asked to contact the manufacturer/supplier directly for faulty products, to give you the best service possible. In this case, your invoice is your proof of purchase.
2) I am not satisfied with the product or I have received a wrong item
If you are not satisfied with your purchase or received a wrong item, you may return it to us within 14 days after purchase by sending an email to email@example.com accompanied by a letter to Vescape GmbH, Zionskirchstr. 51, 10119 Berlin, Germany, so that we can collect the item. In this case, the delivery cost will be payable by you. The delivery cost depends on the product, its weight and your address. The delivery cost may vary between 30 and 90€.
The item must be returned in its original packaging and be packed in secure appropriate packaging. Once the item is received back, it will be inspected it to make sure it has not been used and is in its original condition. If any item received when purchasing is found to be missing on inspection, you will have to pay for it in full.
Your invoice is your proof of purchase and has to be sent back to us together with the item.
Please note that Vescape GmbH will not accept goods returned in non-original or damaged packaging.
3) Damaged packaging or product
When the transport company delivers your order, it is very important to check it.
Please count the pieces you receive and look for damage to the packaging. If the number of boxes you receive is different from the number of pieces on the carrier’s delivery note, DO NOT ACCEPT DELIVERY.
If the packaging is damaged, DO NOT ACCEPT DELIVERY, or NOTE DAMAGE TO PACKAGING on the delivery note next to your signature.
Signing the delivery note means that you accept the order; your signature is an acceptance that you have received all the pieces and that the packaging was in good condition.
Please contact us as soon as possible if there are any problems upon delivery.
If the product delivered is different from the one you ordered, we will arrange to have this item collected and send out the product requested free of charge.
7. Safety and Confidentiality
Vescape GmbH keeps all information confidential and ensures that all information collected are solely used by Vescape GmbH for processing transactions or commercial purposes. According to Framework Law regulations 5/1992, of 29 October, modified by Framework Law 15/1.999, of 13 December, of Personal Data Protection (LOPDP), the information Vescape GmbH collects from your registration or your account will only be used to process transactions and eventually send you special offers per e-mail. Vescape GmbH pledges to maintain the safety of your personal information according to the european law quote above. In case the information is used in any other way, previous consent from the customer will be necessary.The customer can access his data at any time. In case the customer wished to delete his account, he must contact Vescape GmbH per e-mail or per post.
8. Applicable Legislation and Jurisdiction
All sales and any dispute arising from it for any reason in law whatsoever shall exclusively be subject to the laws prevailing in the Federal Republic of Germany.
